Application Steps

Obtain Job Offer

Obtain a Job Offer from a Sponsoring US Company. An employer must agree to sponsor you, as individual applications are not permitted.

Employer Files LCA

Employer Files the Labor Condition Application (LCA) with the Department of Labor (DOL). The company commits to paying a salary not less than the prevailing wage for the occupation.

Submit H-1B Petition

Employer Submits H-1B Petition to USCIS. After LCA approval, the employer files Form I-129. Applications enter the electronic lottery for selection.

Preliminary USCIS Approval

If selected in the lottery, the petition is reviewed and approved by USCIS.

Embassy Visa Application

After USCIS approval, the applicant attends an interview at the US Embassy/Consulate to complete the visa process.
