Employer Files TLC

US Employer files Temporary Labor Certification (TLC) with the Department of Labor (DOL) to prove that qualified US workers are unavailable.

File Form I-129

Employer Files Form I-129 with USCIS. After TLC approval, the employer files the official petition.

USCIS Approval

If approved, the worker receives a case number for the visa application.

Embassy Visa Application

The worker attends an interview at the US Embassy or Consulate in their home country.

Travel and Start Work

Upon receiving the visa, the worker can enter the United States and begin the specified job.

Official job contract or job offer from the US employer.

Copy of the DOL's approval (Temporary Labor Certification).

Copy of USCIS approval of Form I-129.
